1. Who we are & acceptance
Necstaidia (“Necstaidia”, “we”, “us”, “our”) is operated by
[CHANGE ME — your full legal name, or "Necstaidia S.R.L." once incorporated]. These Terms of Service, together with the documents they link
to, form the “Terms” — a legally binding agreement between you and us that
also serves as the End User Licence Agreement (EULA) for the Necstaidia game.
The “Services” means the Necstaidia game on PC, iOS, Android, and web (the
“Game”), our website at https://necstaidia.com, our web shop at
https://gameshop.necstaidia.com, and related features, content, and online services we provide.
By creating an account, installing or using the Game, or making a purchase, you accept these
Terms and our Privacy Policy. If you do not agree, do
not use the Services.
2. Eligibility & age
The Services are intended for a general audience and are not directed to children.
You must be at least 13 years old to use the Services. If you live in the
European Economic Area (EEA), you must be at least the age of digital consent in your country
(this is between 13 and 16 depending on the member state, and is 16 in
several countries, including Romania).
If you are below the age of digital consent in your country but at least 13,
you may only use the Services with the consent and involvement of a parent or legal guardian, who
must agree to these Terms on your behalf. We do not knowingly collect personal data from children
under 13; see the Privacy Policy for
how we handle age and children's data.
By using the Services you confirm that you meet these age requirements and that the information
you give us is accurate.
3. Your account
- You may need an account to access parts of the Services. You are responsible for keeping your
login credentials secure and for activity that happens under your account.
- Provide accurate information and keep it up to date. One person may not maintain multiple
accounts to gain an unfair advantage, evade a ban, or abuse promotions.
- Tell us promptly at [email protected] if you believe your account has been accessed without your permission.
- Your account, characters, and progress are tied to the Services and are not your personal
property; your rights in them are the licence described below.
4. Licence to use the Services
Subject to these Terms, we grant you a limited, personal, non-exclusive, non-transferable,
non-sublicensable, revocable licence to access and use the Services for your own personal,
non-commercial entertainment. We and our licensors own all rights in the Services, including the
Game, its code, art, audio, characters, and trademarks. All rights not expressly granted are
reserved.
You agree not to, and not to help others to:
- copy, modify, reverse-engineer, decompile, or create derivative works of the Services, except
where the law expressly permits it despite this restriction;
- use cheats, bots, automation, memory editors, or any unauthorised third-party software to
modify gameplay or gain an unfair advantage;
- access the Services through anything other than the interfaces we provide, or disrupt, overload,
or attack our servers or networks;
- buy, sell, or trade accounts, currency, or items for real money outside the Services, or use the
Services for commercial purposes without our written permission.
5. Acceptable use & fair play
The Services include online and multiplayer features. You agree to follow our Community Guidelines, which prohibit harassment, hate
speech, cheating, and other harmful behaviour. We operate anti-cheat and moderation systems to
protect players and the integrity of the Game, and we may remove content, reverse improperly
obtained items, or take action against accounts that break the rules.
6. Purchases, Gems, Gold & Virtual Items
The Services let you obtain “Virtual Items” — including “Gems”
(a premium virtual currency), “Gold” (an in-game currency), and other in-game
content such as items, characters, passes, and bundles. Some Virtual Items can be bought with real
money; others are earned through play.
The nature of Virtual Items. When you obtain Virtual Items, you receive a limited,
personal, non-exclusive, non-transferable, revocable licence to use them within the Services. You
do not own them. Virtual Items:
- have no monetary or real-world value and are not your property;
- cannot be redeemed for cash, exchanged for anything of value outside the Services, or
transferred or sold except where we expressly allow it inside the Game;
- are licensed, not sold, even where we use words like “buy”, “purchase”, “sell”, or “own”;
- may be changed, rebalanced, limited, suspended, or discontinued by us, and expire or are lost
if your account is closed or terminated, as described below.
Who you are buying from. Where you buy through the web shop (https://gameshop.necstaidia.com), Necstaidia
is the seller and merchant of record, and payments are processed by Stripe. Where you buy through
the Apple App Store or Google Play, the relevant store is the merchant of record and handles the
transaction under its own terms; we fulfil the matching rewards to your account.
Pricing and taxes. Prices are shown before you confirm a purchase and, for
consumers, are inclusive of applicable taxes (such as VAT). The amount of Virtual Items you receive
for a given price may vary by promotion, region, and over time.
Delivery. Purchased rewards are normally delivered to your account or via in-game
mail shortly after payment is confirmed. If a purchase is not delivered, contact [email protected].
7. Paid random items (loot boxes)
Some optional purchases — such as chests and wishes — grant randomised Virtual
Items, where you know the range of possible rewards and their probabilities, but not the exact
reward, before you buy. We publish the odds for these items in our Paid Random Items & Odds disclosure.
- Buying a random item is always optional; the Game can be played without it.
- Because of the random outcome, you are paying for the chance to receive items, not for any
specific item, and the result is final once revealed.
- Paid randomised items may be unavailable, or offered only as non-paid alternatives, in
countries where local law restricts them.

8. Subscriptions & auto-renewal
We may offer subscriptions (for example, a monthly pass) that give recurring benefits. Before you
subscribe we show the price, the billing period, and what you get.
- Auto-renewal. Subscriptions renew automatically at the end of each billing
period and you are charged the then-current price, until you cancel.
- Cancelling. You can cancel at any time, and cancellation takes effect at the
end of the current paid period. For app-store subscriptions, manage and cancel through your
Apple or Google account settings. For web-shop subscriptions, cancel as described in the Refund & Cancellation Policy.
- If a subscription's price or benefits change, we will give you notice in advance as required by
law, and you may cancel before the change takes effect.
9. Refunds & withdrawal right
Your refund options, and (for EU/EEA consumers buying on the web shop) your 14-day right of
withdrawal and how it applies to digital content delivered immediately, are explained in the Refund & Cancellation Policy. App-store purchases are
refunded by Apple or Google under their policies. Nothing in these Terms removes refund or
withdrawal rights you have under mandatory law.
10. Your content & feedback
The Services may let you create or share content such as names, chat messages, and other materials
(“Your Content”). You keep the rights you have in Your Content, but you grant us a
worldwide, non-exclusive, royalty-free, sublicensable licence to host, store, reproduce, display,
and use it to operate, moderate, and promote the Services. You are responsible for Your Content and
confirm you have the rights to share it.
If you send us ideas, suggestions, or feedback, you agree we may use them without restriction or
obligation to you.
11. Live service, changes & availability
Necstaidia is a live online service that we update over time. We may add, change, suspend, or
remove features, content, events, Virtual Items, and game balance, and we may set, change, or
retire in-game economies and limits. We try to keep the Services available but do not guarantee
uninterrupted or error-free operation, and we may perform maintenance or impose downtime. Where a
change materially and permanently reduces a paid feature you have already bought, your statutory
consumer rights (including any right to a remedy) continue to apply.
12. Suspension & termination
You may stop using the Services at any time and may request account deletion (see the Privacy Policy). We may suspend, restrict, or terminate
your account or access if you breach these Terms or the Community Guidelines, if required by law, or to protect the
Services or other players. Where it is reasonable and lawful to do so, we will give you notice and,
for minor or first issues, a chance to put things right.
If your account is terminated for a serious or repeated breach, you may lose access to your
account and any Virtual Items without compensation, to the extent permitted by law. If we
permanently discontinue the Game as a whole, we will give reasonable notice and handle any
outstanding paid Virtual Items in line with applicable consumer law.
13. Disclaimers
The Services are provided “as is” and “as available”. To the fullest extent permitted by law, we
disclaim implied warranties such as merchantability, fitness for a particular purpose, and
non-infringement. This does not affect mandatory legal guarantees you have as a
consumer (for example, the EU rules on conformity of digital content and services), which continue
to apply in full.
14. Limitation of liability
Nothing in these Terms limits or excludes our liability where it would be unlawful to do so —
including liability for death or personal injury caused by negligence, for fraud, or for any
liability that cannot be limited under mandatory consumer law.
Subject to that, to the extent permitted by law: we are not liable for indirect or consequential
loss, loss of data, loss of profit, or loss of Virtual Items arising from circumstances outside our
reasonable control; and our total liability to you arising out of or relating to the Services is
limited to the greater of (a) the amount you paid us for the Services in the 12 months before the
event giving rise to the claim, or (b) EUR 100. Some jurisdictions do not allow certain
limitations, so some of these may not apply to you.
15. App stores & third-party services
The Services rely on third parties, including the Apple App Store, Google Play, Stripe (web
payments), and our online game backend. When you use those services, their terms and privacy
policies also apply. We are not responsible for third-party services we do not control. The Privacy Policy lists the main providers we work with.
16. Apple App Store — additional terms
If you obtained the Game from the Apple App Store, the following also applies and prevails over
any conflicting term for that version:
- These Terms are between you and Necstaidia only, not Apple. Apple is not
responsible for the Game or its content.
- Apple has no obligation to provide maintenance or support for the Game.
- To the extent permitted by law, Apple has no warranty obligation for the Game, and any claims
that the Game fails to conform to a warranty are our responsibility, not Apple's.
- Apple is not responsible for addressing product-liability claims, third-party intellectual
property claims, or consumer-protection claims relating to the Game.
- Apple and its subsidiaries are third-party beneficiaries of these Terms and may enforce them
against you. You confirm you are not located in a country subject to a US Government embargo or
designated as “terrorist supporting”, and that you are not on any US Government restricted-party
list.
17. Governing law & disputes
These Terms are governed by the laws of Romania, without affecting any
mandatory consumer-protection rules of the country where you live. If you are a consumer in the
EEA, you may bring proceedings in your local courts, and you keep the protection of the mandatory
laws of your country of residence.
If you have a complaint, please contact us first at [email protected] — we aim to resolve
issues directly. EU consumers may also use the European Commission's Online Dispute Resolution
platform at ec.europa.eu/consumers/odr.
18. Changes to these Terms
We may update these Terms as the Services and the law evolve. If we make a material change, we
will take reasonable steps to notify you (for example, in the Game, on this site, or by email) and
state the new effective date at the top of this page. Continuing to use the Services after a change
takes effect means you accept the updated Terms; if you do not agree, you should stop using the
Services and may request account deletion.
19. General
- Entire agreement. These Terms and the documents they reference are the entire
agreement between you and us about the Services.
- Severability. If any part is found unenforceable, the rest remains in effect.
- No waiver. If we do not enforce a right, that is not a waiver of it.
- Assignment. You may not transfer your rights under these Terms; we may
transfer ours to an affiliate or successor (for example, if Necstaidia is
incorporated as a company or as part of a sale of the business), without reducing your rights.
